2. That these 18 individuals have to themselves not less appropriated to themselves than 293,685 square feet of ground more than they have title to, the annual charge for which, at the average rate of the area held by them as per Lease, would be, say £2,080.

From the Surveyor General's plan it would appear that, to carry out the projected Raya, a further area of about 130,000 square feet would have to be filled up (not including roadway), and which ground would be given possession to the holders of the lots in front of and South of them, so as to secure to them sea frontage : in all they
would obtain 423,300 additional square feet, which, with their legitimate area of 261,326 sq. ft., would give them altogether 684,626 sq. ft.
4. That the Government can insist on having rent paid on the ground the Leaseholders have obtained beyond their boundaries, or, if they do not agree to this, that their lands can be resumed for public use, cannot, I should think, be doubted, since it is by their own act that they have destroyed the sea frontage of their lots.
The delicate point is, how to award the land which could be given them in addition, in fact the portion out of the 133,000 feet still requiring to be filled up to the road. No doubt this is most valuable land, and must be particularly so to the holders of the Marine Lots in front of which it is situated; but, as I believe, Government cannot compel them to take it, but
